This is one of the current growth areas for law firms in large part due to the prevailing economic climate. We represent clients in all courts from the District Court right through to the High Court.

 

We are very pro-active as a firm of Debt Collection Solicitors and we aim to give pragmatic as well as cost effective advise.

The monetary jurisdictions of the Irish Courts are currently as follows:

District Court: Debts up to € 6,348.69
Circuit Court: Debts between € 6,348.69 - € 38,092.14
High Court: Debts exceeding € 38,092.14

The Debt collection process in Ireland will usually entail the following initial steps;

  • Initial Letter of Demand
  • Issuing of Proceedings
  • Court Hearing (both Defended and Un-Defended)
  • Judgement (including Foreign Judgements)
  • Seeking payment on foot of Judgement
  • Registration of Judgement

If on foot of a Court Order a Debtor fails to discharge the monies owed then we advise clients on the available Enforcement options which include;

  • Installment Orders
  • Judgement Mortgage
  • Orders for Sale
  • Bankruptcy/Liquidations

To avoid or at worst to minimise debt collection issues for your company we also offer advise on your standard contractual terms and how to amend and improve same.

 

We also offer a service to foreign companies who are owed money here in Ireland or who have obtained foreign court judgements and wish to enforce these debts here in Ireland. This area of law is governed by the Brussels Convention and entails an application to the Master of the High Court.
